Promotion Rules

This Regulation defines the way of acquiring Gift Cards issued by the Exhibitor and using Purchase Vouchers and Discount Codes in the Store. The Regulation applies to all Purchase Vouchers, Gift Cards, or Discount Codes that can be used in the Store.

The terms used in this Regulation mean:

Purchase Voucher - A goods voucher, with a specified Expiry Date and Value, issued by the Partner, entitling the User to redeem it in the Store, consisting of a sequence of 10 digits and letters making up the Voucher number.

Expiry Date - the last calendar day of validity of the Purchase Voucher, Gift Card, or Discount Code, on which such Voucher, Card, or Code may be used and after which they expire and cannot be used; the Expiry Date is specified in the content of the Voucher, Card, or Code or in the absence of such determination in their content - 12 months from the date of purchase.

Gift Card - A goods voucher, in the form of a card, issued by the Exhibitor, entitling the User to redeem it in the Store, consisting of ten digits and letters making up the Gift Card number, hidden under a scratch-off layer. Each Gift Card also has a six-digit verification code; the Gift Card is not a payment card, electronic money instrument, or other payment instrument.

Discount Code - an alphanumeric character sequence provided to the User by the Exhibitor or Partner, entitling the User to a discount on products offered in the Store; the discount amount and Expiry Date are specified in the Discount Code description.

Buyer - a person who buys a Gift Card from the Exhibitor, having full legal capacity.

Partner - an entity cooperating with the Exhibitor in promotional activities, acting as a distributor or seller of Purchase Vouchers, Gift Cards, or Discount Codes.

Regulation - this regulation.

Store Regulations - the store regulations available at: https://gerlachstore.uk/content/terms-and-conditions.

Store - an online service operated by the Exhibitor at www.gerlachstore.uk, where by making purchases, the User can redeem Purchase Vouchers, Gift Cards, or Discount Codes.

User - a person who legitimizes themselves (being the holder of) a Purchase Voucher, Gift Card, or Discount Code and redeems it on gerlachstore.uk website.

Value - the amount expressed in Polish Zloty (PLN), for which the Purchase Voucher or Gift Card is issued at the time of their issuance.

Exhibitor - "GERLACH" Joint Stock Company based in Drzewica, ul. Braci Kobylańskich 41, 26-340 Drzewica, entered into the National Court Register under number 55281, whose registration files are kept by the District Court for Łódź-Śródmieście in Łódź in the XX Economic Department of the National Court Register, using tax identification number (NIP): 7990003388, REGON: 670081420, with share capital of PLN 2,210,575.00, fully paid up.

§1. General provisions

  1. A Gift Card or Purchase Voucher can be used only once, in a single transaction. The User may not reuse the Gift Card or Purchase Voucher, even if there are remaining funds on them.
  2. The User should use the Value of the Gift Card or Purchase Voucher in full.
  3. If the value of the goods purchased by the User in the Store is lower than the Value covered by the Gift Card or Purchase Voucher, the remaining amount (difference) cannot be used by the User and is forfeited (not subject to any refund).
  4. The Buyer can transfer the Gift Card to any other person.
  5. The Exhibitor will redeem Gift Cards, Purchase Vouchers, or Discount Codes provided by the User when making purchases at the Store, regardless of whether the User obtained them legally.
  6. The Exhibitor will not verify, when making purchases at the Store by the User, whether the User obtained the Purchase Voucher, Gift Card, or Discount Code in accordance with the law.
  7. A Gift Card, Purchase Voucher, or Discount Coupon can only be redeemed before the Expiry Date. After the Expiry Date, the Exhibitor will not honor the entitlements resulting from the Purchase Voucher, Gift Card, or Discount Code. The unused Value is not refundable to the Buyer or User.
  8. If the value of the goods purchased by the User in the Store using a Gift Card or Purchase Voucher is higher than the value of such Card or Voucher, the User is obliged to pay the difference in a form accepted by the Store in accordance with its regulations.
  9. The Value of purchases made using a Gift Card will be deducted from the available funds on it.
  10. A Gift Card or Purchase Voucher cannot be exchanged, in whole or in part, for cash. Funds deposited on a Gift Card or Purchase Voucher are not refundable. These provisions do not apply to the withdrawal from the sales contract of a Gift Card or Purchase Voucher.
  11. When paying with a Gift Card, the User is not entitled to receive change in cash or a Purchase Voucher.
  12. The Exhibitor is not responsible for the loss or destruction of a Gift Card or Purchase Voucher and is not obliged to issue another Card or Voucher in place of the lost or damaged one.
  13. Gift Cards or Purchase Vouchers are not subject to reservation or blocking.
  14. The possibility and rules of refunding cash in exchange for a Purchase Voucher are determined by the Partner's regulations. The Exhibitor is only responsible for redeeming the Purchase Voucher at the Store, according to the rules specified in the Regulation. All other provisions regarding the Purchase Voucher, especially the responsibility for its issuance, content, and rights arising from it, are the responsibility of the Partner.

§2. Acquiring a Gift Card

  1. Gift Cards can be purchased electronically in the Store or as part of another form of cooperation with the Exhibitor. The detailed rules of using the Store are defined in its regulations, available at the address: www.gerlachstore.uk.
  2. The minimum Value of a Gift Card is 100.00 PLN (one hundred Polish Zlotys).
  3. When purchasing a Gift Card, the Buyer determines its Value. The currently available Gift Card options are defined by the current Store offer or individual agreements between the Exhibitor and the Buyer, specified as part of another form of cooperation.
  4. In exchange for funds equal to the Value of the Gift Card, the Exhibitor issues and sends the Buyer the Gift Card.
  5. After paying for the Gift Card, the Buyer receives a Gift Card from the Exhibitor with a unique ten-character set of digits and letters making up the Gift Card number (hidden under a scratch layer) and a six-digit code verifying the Card.
  6. The Gift Card is delivered to the Buyer by registered mail or courier.
  7. The Gift Card is valid for a period of six (6) months from the date of purchase. After this period, the Gift Card expires, and any unused funds are not refundable.
  8. Payment for a Gift Card with another Gift Card or Purchase Voucher is not allowed.

§3. Purchasing with a Gift Card or Purchase Voucher

  1. Gift Cards or Purchase Vouchers can only be used to purchase goods in the Store.
  2. Gift Cards or Purchase Vouchers with a valid Expiry Date can be used as a means of payment for goods purchased in the Store.
  3. The User, wishing to pay for goods purchased in the Store using a Gift Card or Purchase Voucher, should enter the Gift Card or Purchase Voucher number in the shopping cart during the purchase transaction.
  4. The User can only use one Gift Card or one Purchase Voucher for a single purchase (Gift Cards and Purchase Vouchers do not combine).
  5. The User cannot simultaneously use a Purchase Voucher and a Gift Card or Discount Code (Gift Cards, Purchase Vouchers, and Discount Codes do not combine).
  6. A Gift Card or Purchase Voucher can be used to purchase discounted or promotional goods in the Store.
  7. The User can use a Gift Card or Purchase Voucher once, before the Expiry Date.

§4. Withdrawal from the Gift Card sales contract

  1. The Buyer, being a consumer within the meaning of the Civil Code (the Act of April 23, 1964, Civil Code (consolidated text Dz. U. of 2017, item 459, as amended)), has the right to withdraw from the unused sales contract of a Gift Card within 14 days of receiving the Card.
  2. In the event of withdrawal from the Gift Card sales contract, the Exhibitor invalidates the Gift Card number and blocks the option to make purchases with it within 48 hours from receiving the declaration of withdrawal from the Gift Card sales contract.
  3. If the User uses the Gift Card before withdrawing from the Gift Card sales contract, only the difference between the Value of the Gift Card and the value of the purchased goods is refundable to the consumer.
  4. If the User redeems the Gift Card between the submission of the declaration of withdrawal from the Gift Card sales contract by the Buyer and its invalidation by the Exhibitor, only the difference between the Value of the Gift Card and the value of the purchased goods is refundable to the Buyer.
  5. Information on how to exercise the right of withdrawal from the Gift Card sales contract along with the withdrawal form template is included in the Store regulations.

§5. Withdrawal from the sales contract of goods purchased with a Gift Card

  1. The rules and deadlines for withdrawal from the sales contract of goods in the Store are defined in the Store regulations.
  2. In the event of the User withdrawing from the sales contract of goods concluded through the Store, the User is not entitled to a cash refund to the extent that the sales price was covered by a Gift Card.
  3. In the situation described in point 5.2., the User will receive a refund on a new Gift Card to the extent of the payment made with it. Any surplus paid by the User in cash or by any other acceptable form, is subject to refund according to the Store regulations.
  4. In the situation described in point 5.3., the Exhibitor will issue the User a new Gift Card covering the value of those funds.

§6. Using a Discount Code

  1. Discount Codes with a valid Expiry Date can only be used as a means of payment for goods purchased in the Store.
  2. The User, when wanting to pay for goods purchased in the Store using a Discount Code, should enter the discount code during the purchase transaction in the shopping cart, depending on the type of promotional code.
  3. The User can only use one single-use or multiple-use Discount Code for one purchase (Discount Codes do not combine).
  4. A single-use Discount Code can only be used once, for one transaction - after using such a Discount Code, it expires and cannot be used again.
  5. The User cannot simultaneously use a Discount Code, Purchase Voucher, or Gift Card (Gift Cards, Purchase Vouchers, and Discount Codes do not combine).
  6. A Discount Code cannot be used to purchase goods subject to discounts, price reductions, or promotions in the Store or to purchase gift cards.
  7. A multiple-use discount code can be used multiple times during the code's validity period.
  8. Discount codes for the entire offer do not apply to knives from the N46 line (N46-D chef's knife with EAN code 5901035514737, N46-K chef's knife with EAN code 5901035514744, N46-DS chef's knife with EAN code 5901035514751). An exception may apply to discount codes assigned exclusively to those products.
  9. Discount codes for the entire offer do not include gift cards.

§7. Refusal of redemption

  1. The Exhibitor has the right to refuse the redemption of a Gift Card or Purchase Voucher if:
  2. The correctness of the Gift Card or Purchase Voucher number cannot be verified with the Partner,
  3. The Exhibitor receives credible information from the Partner that the Purchase Voucher has already been used with another supplier.

§8. Withdrawal from the sales contract of goods purchased with a Purchase Voucher

  1. The rules and deadlines for withdrawal from the sales contract of goods in the Store are defined in the Store regulations.
  2. In the event of the User withdrawing from the sales contract of goods concluded through the Store using a Purchase Voucher, the User is not entitled to a refund of the Purchase Voucher.

§9. Final provisions

  1. The acquisition or redemption of a Gift Card, Purchase Voucher, or Discount Code implies an acceptance of this Regulation.
  2. The User confirms familiarity with and acceptance of the Regulation before making a purchase using a Gift Card, Purchase Voucher, or Discount Code.
  3. Gift Cards obtained from a source other than the Exhibitor, Purchase Vouchers obtained from a source other than the Partner, or Discount Codes obtained from a source other than the Exhibitor or Partner, are void and do not entitle to purchase in the Store.
  4. Any matters not covered in the Regulation are subject to the provisions of the Civil Code, in particular the provisions regarding bearer instruments, and other applicable legal regulations, in particular the Act of May 30, 2014 on consumer rights.
  5. The content of the Regulation is available free of charge at the website: https://gerlachstore.uk/content/terms-and-conditions. The form of providing the Regulation allows obtaining, reproducing, and storing its content using the teleinformatics system utilized by the User.
  6. The Exhibitor reserves the right to amend the Regulation for legal or organizational reasons.
  7. Notification of changes to the Regulation and the date of their entry into force will be made by posting them on the website https://gerlachstore.uk/content/terms-and-conditions and in the Store for a period of at least 30 days. The change cannot infringe on rights already acquired by the User or Buyer.
  8. In the event of a change in the Regulation, the new regulation will replace this Regulation. However, the current Regulation will remain effective regarding Gift Cards purchased based on it before the date of entry into force of the new regulation.
  9. This Regulation comes into effect on March 28, 2024, and applies to Gift Cards, Purchase Vouchers, or Discount Codes acquired or activated on or after this date.
  10. The Exhibitor reserves the right to terminate the Gift Card, Purchase Voucher, or Discount Code program at any time without giving a reason. Users will be informed in advance of the program's termination in a manner specified in point 9.7.
  11. Gift Cards purchased before the program's termination date can be redeemed under the previous conditions.

For matters not regulated in this Regulation, the provisions of the Store regulations, available at: https://gerlachstore.uk/content/terms-and-conditions, shall apply.
